Terms of Use

1. Who we are

Hey Love Letters ("Hey Love Letters", "we", "us") is an online service operated by an individual based in Brazil under the brand name Hey Love Letters. The same operator also runs the Portuguese-language version of the service in Brazil under the brand name Love Cards (lovecards.com.br). These Terms of Use (the "Terms") are an agreement between you and the operator of Hey Love Letters and apply to your use of the English version of the site and to purchases made on it. 2. Acceptance of these Terms

By creating an account, uploading content, making a purchase or otherwise using Hey Love Letters, you agree to these Terms and acknowledge our Privacy Policy, which explains how we handle personal information. If you do not agree, please do not use the service.

3. The service

Hey Love Letters lets you create personalized digital cards: web pages with photos, music and messages. A card is delivered as a private link and a QR code that you can share. Creating and previewing cards is free, with the limits of the free plan. Paid plans unlock additional features, such as sharing a card and, on plans that include it, exporting the card as an MP4 video. What each plan includes is described on the pricing page.

Anyone who has the link or the QR code of a shared card can view it. Please share it only with people you want to see it.

4. Eligibility and your account

You must be at least 13 years old to use Hey Love Letters. The service is not directed to children under 13. If you are under 18, you may use Hey Love Letters only with the consent and supervision of a parent or legal guardian, who agrees to these Terms on your behalf.

You are responsible for the information you provide when signing up, for keeping your password confidential and for activity under your account. Tell us promptly at support@heyloveletters.com if you believe your account has been accessed without your permission.

5. Your content and the license you give us

"Your content" means the photos, text, music selections and other material you add to Hey Love Letters. By uploading or adding content, you represent and warrant that:

• You own the content or have the permission of the rights holder to use it in this way.
• The content does not violate anyone's privacy, publicity or image rights, or any other rights of third parties.
• You have the consent of every identifiable person who appears in the photos you upload.
• The content does not infringe anyone's copyright, trademark or other intellectual property rights.

License: you keep ownership of your content. You grant Hey Love Letters a non-exclusive, worldwide, royalty-free license to host, store, copy, process and display your content solely to provide the service to you (for example, to show your card to people who have its link and to generate its QR code or video). This license ends when you delete the content or your account, except for copies that are lawfully kept as described in our Privacy Policy.

6. Acceptable use and moderation

You may not use Hey Love Letters to publish or upload content that:

• Is illegal, harassing, defamatory or offensive, or violates the rights of others.
• Infringes copyrights, trademarks or other intellectual property rights.
• Contains nudity, sexually explicit material or material unsuitable for minors.
• Is spam, phishing, malware or otherwise deceptive.
• Exposes another person's personal information without their consent.
• Promotes hatred, discrimination or violence.

You also may not attempt to interfere with the service, access other users' cards or accounts without permission, or use automated means to scrape or overload the site.

Uploaded images may be screened automatically for prohibited content. We may remove, hide or disable any content that we reasonably believe violates these Terms or the law, or is harmful to other people, without prior notice. For serious or repeated violations, we may suspend or close the account.

7. Copyright complaints

We respect the intellectual property rights of others and respond to notices of alleged copyright infringement that substantially follow the requirements of the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512). To report content on Hey Love Letters that you believe infringes your copyright, send a written notice by email to support@heyloveletters.com with the subject "Copyright notice", including:

• Your physical or electronic signature (as the copyright owner or a person authorized to act on the owner's behalf).
• Identification of the copyrighted work you claim has been infringed.
• Identification of the material you claim is infringing, with enough information for us to locate it (for example, the URL of the card).
• Your contact information: name, mailing address, telephone number and email address.
• A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law.
• A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

We will review the notice and, if it is valid, remove or disable access to the material within 5 business days and make reasonable efforts to inform the user who posted it.

Counter-notice: if your content was removed and you believe this was a mistake or misidentification, you may send a counter-notice to the same email address, including: your physical or electronic signature; identification of the material that was removed and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification; and your name, address and telephone number, with a statement that you consent to the jurisdiction of the U.S. federal district court for the judicial district where your address is located (or, if your address is outside the United States, any judicial district in which Hey Love Letters may be found) and that you will accept service of process from the person who sent the original notice or that person's agent. We may forward the counter-notice to the person who sent the original notice and may restore the material in 10 to 14 business days unless that person informs us that they have filed a court action seeking to restrain the alleged infringement.

Please note that a person who knowingly makes a material misrepresentation in a notice or counter-notice may be liable for damages (17 U.S.C. § 512(f)). We may close the accounts of users who repeatedly infringe the copyrights of others.

8. Prices and payment

• Prices: on the English site, prices are in U.S. dollars (USD) and are shown on the pricing page and on the checkout page before you pay. The price shown at checkout is the amount you will be charged.
• One-time payment: every paid plan is a single, one-time payment. There is no subscription and no automatic renewal: we will never charge your card again unless you make a new purchase.
• Payment processing: payments are processed by Stripe through Stripe Checkout. You enter your card details on Stripe's secure payment page; Hey Love Letters never receives or stores your full card number. Your payment is also subject to Stripe's terms and privacy policy.
• Card issuer fees: because Hey Love Letters is operated from Brazil, your bank or card issuer may treat the purchase as an international transaction and charge its own fees (such as foreign transaction fees). Those fees are set by your card issuer, not by us.
• Delivery: the paid features are unlocked in your account as soon as the payment is confirmed, usually within moments.
• "Lifetime" plan: "Lifetime" means for as long as your account exists and Hey Love Letters operates the service. It does not refer to your lifetime or to any guaranteed minimum period.
• Price changes: we may change prices for future purchases. A price change never affects a purchase you have already paid for.

9. Refunds

7-day refund window. You can ask for a full refund within 7 calendar days of your purchase, for any reason. After those 7 days, we will still refund your payment in these cases:

• You were charged more than once for the same purchase, or charged by mistake.
• A technical problem on our side prevents you from using the feature you paid for and we are unable to fix it within a reasonable time after you report it.
• A refund is required by the law that applies to you.

To request a refund, email support@heyloveletters.com with the subject "Refund", the email address of your account, the date of the purchase and a short description of the problem. Approved refunds are issued through Stripe to the card used for the original purchase; the time it takes to appear on your statement depends on your card issuer. When a purchase is refunded, the paid plan of that purchase is cancelled and its paid features are removed from your account.

If you have a problem with a charge, please contact us first so we can fix it quickly. This does not limit any rights you have with your card issuer. If a payment is reversed through a chargeback, the paid plan of that purchase may be cancelled.

10. Deleting your account and termination

You can delete your account at any time under Profile → "Delete my account". Deletion is immediate and cannot be undone: your personal information, cards, images and other content are removed, and links to your cards stop working. Deleting your account does not by itself entitle you to a refund (see section 9). Payment history is kept in anonymized form, as explained in our Privacy Policy.

We may suspend or close your account if you seriously or repeatedly violate these Terms, if required by law, or to protect other users or the service. Where appropriate, we will tell you why.

11. Availability and changes to the service

We work to keep Hey Love Letters available around the clock, but we do not guarantee uninterrupted availability. We may perform maintenance, and we may change, add or remove features. If we decide to discontinue the service as a whole, we will make reasonable efforts to notify you by email in advance.

12. Our intellectual property

The Hey Love Letters software, design, themes, brand, logo and visual identity belong to Hey Love Letters and are protected by intellectual property laws. You may not copy, modify, distribute or reverse engineer them, except as allowed by law. Your content remains yours, as described in section 5.

13. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, HEY LOVE LETTERS IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT CONTENT WILL NEVER BE LOST.

Some states do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Please keep your own copies of photos and other content you care about.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HEY LOVE LETTERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US$50.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud, gross negligence or willful misconduct, or any rights you have as a consumer that cannot be waived.

15. Indemnification

To the extent permitted by law, you agree to reimburse Hey Love Letters for reasonable losses and expenses (including reasonable legal fees) arising from third-party claims caused by content you upload or by your violation of these Terms or of the rights of others. We will notify you of any such claim and allow you to participate in the defense.

16. Governing law and disputes

These Terms are governed by the laws of Brazil, where Hey Love Letters is operated. If you are a consumer residing in the United States, this choice of law does not deprive you of the protection of the mandatory consumer protection laws of your state of residence.

Contact us first: if you have a dispute with us, please email support@heyloveletters.com describing the issue and what you would like us to do. We will try in good faith to resolve it informally within 30 days. If we cannot resolve it, you may bring a claim in the courts of your place of residence, and you may always use small claims court where its requirements are met.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on the site before the changes take effect. Changes apply going forward and do not affect purchases already made. If you continue to use Hey Love Letters after the changes take effect, the updated Terms apply; if you do not agree, you may stop using the service and delete your account.

18. General

These Terms and our Privacy Policy are the entire agreement between you and Hey Love Letters about the service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not transfer your rights under these Terms without our consent. A Portuguese version of these Terms applies to the Brazilian (Portuguese) version of the site.
